Darling Walks Waiver and Informed Consent

PARTICIPATION WAIVER & INFORMED CONSENT

Applicable to all Darling Walks experiences, including urban walking tours and beach based walking tours.

Please read carefully. By signing this document, you acknowledge the risks of participation and accept the responsibilities outlined below.

1. Acknowledgment of Risk

I understand that participation in Darling Walks experiences may involve risks and hazards, including but not limited to:

  • Uneven or slippery terrain (shells, roots, rocks, sand, dirt paths, uneven sidewalks)
  • Sudden weather changes (rain, wind, heat, cold)
  • Exposure to sun, insects, or wildlife
  • Physical exertion such as standing or walking for extended periods
  • Use of drinkware, or other equipment
  • Use of public or private infrastructure (e.g. washrooms etc.)
  • Participation in group activity environments
  • Consumption of coffee or other refreshments purchased from a third-party vendor as part of the experience

I acknowledge that these risks may cause injury, illness, discomfort, or property loss, and I voluntarily choose to participate. I understand that Darling Walks takes precautions to support guest safety but cannot eliminate all risk.

2. Personal Responsibility

I agree to:

  • Wear appropriate clothing, sun protection and footwear
  • Stay with the group and follow guide instructions
  • Be respectful to fellow guests, the land, and wildlife
  • Disclose any medical concerns that may affect my safe participation
  • Disclose any food allergies, sensitivities, or dietary restrictions before consuming any item provided by a third-party vendor
  • Carry any required personal medication (e.g., inhalers, EpiPens)
  • Confirm that I am physically able to complete the walking tour, which involves standing and walking for the duration of the experience

If I am attending with a minor child under my care, I accept responsibility for supervising them and ensuring their safety throughout the experience.

3. Guest Conduct

Darling Walks does not permit guests on its experiences who are, or appear to be, intoxicated. Guests who are intoxicated or disorderly will be asked to leave the experience, and no refund will be issued. Smoking is not permitted during the tour or within any parks the tour passes through.

4. Third-Party Vendors

Some Darling Walks experiences include a coffee stop, purchased directly from an external café or vendor along the route. I understand that Darling Walks, its guides, staff, and affiliates are not liable for allergic reactions, illness, quality issues, or any other harm arising from food or beverages supplied by an external provider.

5. Photography and Media

I understand that by participating in a Darling Walks experience, I grant Darling Walks the right to use photographs or video recorded during the experience for marketing and promotional purposes, unless I submit a written opt-out request to Darling Walks prior to the tour.

6. Waiver & Release of Liability

I release Darling Walks, its guides, staff, and affiliates from any and all claims of liability related to injuries, property damage, or loss that may occur during participation in a Darling Walks experience or activity, unless caused by gross negligence. I understand that this waiver applies even if risks arise from land conditions, third-party vendors, or other factors beyond anyone's control.

7. Final Acknowledgement

By participating in this experience, I confirm that I have read and understood the information above, and I voluntarily accept the risks and responsibilities involved.

I understand and consent to the use of an electronic signature, and that my electronic signature is legally equivalent to a handwritten signature.
